By accepting these terms and conditions, the Applicant, as the term is defined below, agrees with the following terms and conditions.
Definitions
Application shall mean the software application and/or service described in this application form including all related material and information that has been provided in the application form, as well as any subsequent material and information provided by the Applicant relating to the Application.
Applicant shall mean the company or person(s) who submit(s) the Application for the possible grant.
1. Scope
1.1 These terms and conditions cover the information provided in the grant application form and subsequent communication related to this application before the possible grant allocation.
1.2 Further agreement will be signed to cover the possible grant allocation.
2. Intellectual Property Rights
2.1 The Applicant owns and will maintain the intellectual property rights included in the Application.
2.2 The Applicant shall ensure that she/he has the rights, or will have the rights at the relevant time, to deal with the intellectual property rights included in the Application.
2.3 Applicant agrees to maintain the Application as exclusive on Windows and / or Nokia platform until 90 days after launch. Thereafter the Applicant may publish a version of the app to any platform.
3. Privacy issues
3.1 The applicant agrees that if she/he submits the Application, the personal data included in the Application will be collected for the purposes of processing the Application. The collected personal data will be processed in accordance with the privacy statement.
3.2 If you become aware of any breach or possible breach of privacy, you must notify Aalto University immediately.
4. Confidential Information
4.1 Subject to clauses 4.2, 4.3 and 4.4, Applicant and Aalto University shall not disclose Application or information included in the Application to anyone, without the prior written consent of the other party. For the sake of clarity it is agreed on hereto that Aalto University can disclose Application and information included in the Application to Nokia Corporation and Microsoft Corporation for the purposes of effective operation of the AppCampus Funding Program without the separate consent from the applicant.
4.2 However, a party can disclose information included in the Application to the extent that it is needed, to its internal personnel, solely to enable effective management or auditing of the Application-related activities.
4.3 In addition, the Application and information included in the Application may be disclosed, to the extent that it is needed solely to enable effective management or auditing of the Application-related activities, to third parties such as external consultants provided that such third parties are bound by confidentiality undertakings not less restricted than those included in these terms.
4.4 In case information is disclosed under clauses 4.2 and/or 4.3 the discloser shall:
a) notify the receiving party that the information is confidential; and
b) not provide the information unless the receiving party agrees to keep the information confidential.
4.5 In case Aalto University provides confidential information to the Applicant, she/he agrees to secure it against loss and unauthorized access, use, modification or disclosure.
5. Right to correct or withdraw information
5.1 The Applicant keeps the right to modify or withdraw any information related to the Application at any time.
6. Liability and Miscellaneous
6.1 The Applicant understands that Aalto University takes no responsibility and/or liability for any damages or claims arising out of the Application, and in any case Aalto shall not be responsible for any indirect or consequential damages and in all cases the aggregate liability of Aalto University under these terms towards the Applicant shall not exceed five thousand euro (5000 €).
6.2 The laws of Finland, except for its choice of law provisions shall be applied to these terms.
6.3 Any controversy that cannot be amicably settled between the parties shall be settled in by arbitration under the Arbitration Rules of the International Chamber of Commerce. The arbitration will be conducted in Helsinki, Finland, in the English language. The award will be final and binding on the Parties.

4. The purpose for processing the personal data / the purpose for the use of a register
The purpose for processing the personal data is to handle the applications submitted to the AppCampus program. Application means the software application and/or service described in this application form including all related material and information that has been provided in the application form, as well as any subsequent material and information provided by the applicant relating to the application.
5. Content of the register
Names, address and telephone numbers, e-mail addresses, business information, application project information of the data subject/applicant.
6. Regular sources of information
Only information received from and disclosed by the applicant with his/her sole consent is to be handled.
7. Regular destinations of disclosed data and whether the data is transferred to countries outside the European Union or the European Economic Area
Data included into the applications are to be transferred to co-operative partners Nokia Oyj and Microsoft Corporation and additionally to entities organizing competitions in case the applicant submitted the application by referring to such competition in the AppCampus submission form for the purpose of reviewing and selecting the applications. In case personal data is to be transferred outside the EU the data will remain protected by the applicable European data protection legislation.
8. The principles how the data file/register is secured
- A. Manual register (place of storage and the methods of protection)
- Data will be kept protected in accordance to normal business practices.
- B. Data register/ADP register
- Data will be protected in accordance to industry normal security standards.
9. Right of access
Upon request to the contact person mentioned above, every data subject has the right of access, after having supplied sufficient search criteria, to the data on him/her in a personal data file, or to a notice that the file contains no such data in accordance with the Personal Data Act of Finland (523/1999).
10. Rectification
Upon the request to the contact person mentioned above, every data subject has the right to request to erase or supplement personal data contained in its personal data file and erroneous, unnecessary, incomplete or obsolete as regards the purpose of the processing in accordance with the Personal Data Act of Finland (523/1999).
